General scope

Scope of services
Through this contract the sale of internet services through the website of the provider is regulated. We guarantee a availability of 99% over the average of a year for the availability of our website. The scope of the service is limited to the services offered at the time of the registration.
Conclusion of contract
The contract begins with acceptance of an offer made upon sending of an invoice. The displayed offers are a non-binding invitation to make an offer through taking contact via contact form, E-Mail or phone. The ordering process involves the following steps: Taking initial contact to exchange information and details. Accepting an offer made via E-Mail or verbal communication Sending of invoice Receival of payment Sending of hardware Sending of login information for the OlsiTrack system With sending of the invoice the contract becomes valid.
Contract duration
Unless otherwise agreed upon the contract is in place for an idefinite period of time. The contract has a minimum contract period. The minimum contract period is 12 months. If the customer does not cancel the contract it is renewed automatically at the end of the year for 12 more months. The contract can be canceled without reason by the customer to the end of every year. The provider is entitled to terminate the contract relationship for good cause following prior notice. Contract termination is only binding if it is in one of the following forms: written letter, electronic mail.
Pricing
If not otherwise stated all prices are net prices and do not contain added value tax.
Terms of payment
For recurring payments an invoice is issued once per year. The sum is payable for 12 months, this may be adjusted to less to streamline the invoicing process off the provider.(I prefer sending out all invoices in the beginning of the year) All payments are carried out through issuing an invoice. The customer has the following method of payment: SEPA wire transfer. All other forms of payment will be rejected. Payment is due immediately after the invoice is received and is to be transferred to the banking account specified in the invoice. The customer is bound to pay the amount mentioned in the invoice within 30days. After the expiry of the payment period the customer will be in default without warning.
Availability of service
The service is at the latest available upon receiving of the shipment. If the provider can no longer offer the service anymore, he has the right to withdraw from the contract with the customer. If the contract has not been in existence for no more than 3 years, the customer can be partially reimbursed for hardware expenses if he returns the hardware to the provider. Reimbursment for hardware depends on hardware condition and duration of contract. After 3 years reimbursement is no longer possible.
Right of withdrawal
Regulations for distance selling contracts are not applicable to customers that are bussinesses. Thus no right of withdrawal is aviable. The provider also does not grant this.
Exclusion of liability
The provider assumes no liability for direct damages, secondary damages or lost profits due to technical problems or disturbances. With regards to customers that are businesses we are not liable for minor negligence of contractual obligations.
Language, jurisdiction and applicable law
The contract is formulated in English language. The execution of the contractual relationship will be in english. Only the law of Norway is applicable. For services of this contract the place of business is Trondheim, Norway. For business customers that are no legal person, jurisdiction for disputes from this contract is the court responsible for Trondheim.
Severablility clause
Should any of the provisions of these terms and conditions be invalid, illegal or unenforceable the remaining provisions of these terms and conditions shall not be affected or impaired thereby.
